North Dakota What Happens Next?

When match information is received, North Dakota Child Support will assess the information to determine the claim type. The action taken will differ depending on the claim type.

Worker Compensation Claims

Once an income withholding order (IWO) has been issued to the worker’s compensation entity, the investigator will issue a Child Support Deduction Order to the appropriate entity to seize up to half of the pending claim. The claimant is sent a copy of the Deduction Order along with a Notice of Deduction Order, notifying them of our action and explaining their rights. The claimant has ten (10) days to request an informal review and/or thirty (30) days to contest the action judicially. If there are no contests, upon adjudication of the claim, the deducted amount must be remitted to the special account provided on the order within seven (7) business days.

Non-Worker Compensation Claims

For all other claims such as personal injury/bodily injury, the investigator will assess the match and the case. The insurance agency will receive three separate documents from the North Dakota High Intensity Enforcement Unit over the life of the claim: the Notice of Lien, the Written Demand to Surrender, and the Certificate of Discharge. The claimant will receive a copy of each document at the time of issuance.

The Notice of Lien encumbers the settlement payable to the claimant up to the amount of the arrears identified on the lien, plus any support that accrued between time of the Notice of Lien and the Written Demand. The investigator will issue the instate Notice of Lien form for instate claims and the federally mandated Notice of Lien form for out-of-state claims. The claimant has 30 days to contest the action.

Barring a contest, the investigator will issue a Written Demand to Surrender Property to the insurance company to seize the asset. As these types of payments can take months or years for the claim to be fully adjudicated, the investigator will often issue amended demand letters that include an updated arrears balance.

Upon receipt of the collection, the investigator will issue a Certificate of Discharge to the insurance company to release or satisfy the lien.
